Thesis Elements Acceptable Use Policy

1. Purpose & Scope

This Acceptable Use Policy ("AUP") governs the use of Thesis Elements software, services, documentation, APIs, and associated infrastructure (collectively, the “Services”). This AUP is incorporated into and forms part of your agreement with Thesis America, Inc. (“Thesis”) regarding access to and use of the Services.

The goal of this AUP is to ensure responsible, legal, and secure use of the Services, protect the integrity of the Thesis Elements platform, and safeguard all users.

2. User Conduct

This AUP is designed to protect customers, users, and the platform itself from misuse or abuse. The examples below are illustrative and not exhaustive. All users must avoid any use of the Services that is unlawful, fraudulent, disruptive, or inconsistent with the intended use of the platform.

3. Prohibited Uses

You and your end users may not use the Services to:

3.1 Unlawful or Harmful Content

  • Transmit or store content that violates any applicable laws, including intellectual property, privacy, export control, or obscenity laws.
  • Infringe any third-party copyright, patent, trademark, or trade secret.

3.2 Email and Communications Misuse

  • Send Unsolicited Bulk Email (spam), SMS or mass marketing emails through the Services.
  • Operate mailing lists without clear opt-in consent and recordkeeping.
  • Promote non-sanctioned services to other Thesis customers.

3.3 Security Violations

  • Access or attempt to access systems without authorization.
  • Introduce malware, ransomware, or any code intended to disrupt system performance.
  • Perform penetration testing, load testing, or similar without prior written approval.

3.4 Personal Data Risks

  • Upload sensitive personal information such as health data, driver’s license, or financial account numbers unless explicitly permitted.
  • Harvest, store, or scrape personal data of other users without appropriate legal basis or consent.

3.5 System Abuse

  • Use automation or bots to access or interact with the Services unless authorized.
  • Impersonate other users or misrepresent affiliations.
  • Interfere with or disrupt the normal operations of the Services, including through excessive API usage or denial-of-service activities.

4. Minimum Age Requirement

Users must be at least 18 years of age to access or use the Services.

5. Customer Responsibilities

  • Customers are responsible for ensuring their employees, contractors, and end-users comply with this AUP.
  • Customers must promptly notify Thesis of any known or suspected violation.

6. Enforcement & Investigation

Thesis reserves the right to suspend or terminate access to the Services for violations of this AUP. Thesis may also:

  • Investigate violations, including by reviewing data or account activity.
  • Cooperate with law enforcement, regulators, or third parties if legally obligated.
  • Require customers to assist in remediating violations by their end-users.

8. Changes to Policy

Thesis may update this AUP periodically. Changes will be effective upon posting or otherwise notifying customers through standard communication channels.
